Terms of Use

These terms govern the use of the Tibalo app and purchases made in the app. By creating an account, you accept them. The French version is the reference version.

1. Publisher

Tibalo is published by CODE FAMILY, a French simplified joint-stock company (SAS) with a share capital of EUR 1,000, registered with the Versailles Trade and Companies Register under SIREN 999 566 995, with its registered office at 76 rue de Vaucanson, 78420 Carrières-sur-Seine, France. EU VAT number: FR26999566995. Phone: [TO VERIFY: CODE FAMILY phone number]. Publication director: Kévin Naudin. Contact: contact@code-family.fr.

These pages are hosted by OVH SAS, 2 rue Kellermann, 59100 Roubaix, France, phone: 1007.

2. The service

Tibalo writes a unique gamebook for each reader from a short description of the story they want. The book is read page by page: you choose your path, fight opponents with dice and manage your adventure sheet. A book has four acts.

Tibalo is available on iPhone, iPad, Mac (through the iPad app) and Android. The service requires an Internet connection to create a book and write its pages.

3. Account

An account is required from the first launch. It is created with an email address; sign-in is passwordless, through a single-use link sent to that address. You are responsible for access to your inbox and your devices. An account is personal.

Tibalo is rated 16+ and is reserved for people aged 16 or over.

4. Content written by artificial intelligence

Tibalo books are written by an artificial intelligence model (Claude, by Anthropic), based on your request. They are not reviewed by a human before being shown to you.

Despite our instructions and filters, a book may contain errors, inconsistencies, passages that do not match your request or, exceptionally, inappropriate content. Books are works of fiction: they are neither reliable information nor advice. Any resemblance to real people is coincidental.

If a page seems inappropriate, report it from the app, with the report button available on every page, or write to us. We review every report.

5. Usage rules

You are responsible for the requests you write. Tibalo refuses to write, and you agree not to request:

A request that refers to an existing work (novel, film, series, game) results in an original world that keeps its tone and genre, with invented names, characters and places: Tibalo does not reproduce protected universes.

You also agree not to circumvent the filters or limits of the service, not to access it by automated means and not to disrupt its operation.

6. Your books

Your requests remain yours. You grant CODE FAMILY the rights strictly necessary to process them in order to write, store and display your book. You may read and use the books written for you for personal, non-commercial purposes [TO VERIFY: licence granted on generated books]. Your books are private: they are not shared with other readers.

7. Free offer and purchases

Free

You can start up to 3 new books for free over a rolling 7-day period: the first act of these books is free.

Paid

The following acts are unlocked with credits, sold as in-app purchases at the following prices, all taxes included, in France:

Acts are unlocked in order. To unlock the next act, Tibalo uses a "full book" credit if you have one left and more than one act remains to be unlocked, otherwise a "one act" credit. Beyond the 3 free books, starting a new book uses a credit: a "one act" credit unlocks its first act, or failing that a "full book" credit unlocks all its acts.

Prices may vary by country and store; the applicable price is the one shown by the store at the time of purchase. These purchases are one-time purchases (consumables), with no subscription or renewal. Purchased credits do not expire.

Purchases are sold and billed by the store you make them from: Apple (App Store) or Google (Google Play). They are managed by our provider RevenueCat and linked to your Tibalo account: to get them back on another device, sign in with the same email address. Unlocked acts remain yours for the lifetime of the account.

If writing a new book fails, the free book or the credit used is returned to you automatically. If writing an unlocked act fails, the act stays unlocked and its writing can be restarted.

Usage limits

To guarantee the service for everyone, daily writing limits apply per account and across the whole service. If a limit is reached, try again later; no credit is used for an act that the limit prevents from being unlocked.

8. Withdrawal and refunds

Credits are sold by Apple or Google: the right of withdrawal and refunds are governed by the terms of the store concerned, without prejudice to your statutory rights. In accordance with Article L221-28 13° of the French Consumer Code, the right of withdrawal no longer applies to a credit you have used: by unlocking an act, you request the immediate writing of this digital content and waive this right for that credit [TO VERIFY: collection of this express consent in the app and confirmation on a durable medium].

Refund requests are made to the store: reportaproblem.apple.com for the App Store, the order history of your Google Play account for Google Play. A purchase refunded by the store removes the corresponding credit from your account; if it has already been used, your balance becomes negative and no credit can be used until it is restored by a new purchase.

9. Availability and liability

The service is provided as is, with the reasonable care expected of a professional. It may be interrupted for maintenance or because of our providers (hosting, artificial intelligence model, app stores), whose availability we do not control.

These terms do not limit the rights you have under the law, in particular the legal guarantee of conformity of digital content (Articles L224-25-1 et seq. of the French Consumer Code).

10. Intellectual property

The Tibalo brand, logo, interface, app texts and code belong to CODE FAMILY. You have a personal, non-exclusive and non-transferable right to use the app.

11. Account deletion and suspension

You can delete your account at any time, from the app (Réglages (Settings), then "Supprimer mon compte" (Delete my account)) or by email: see Delete your account. Deletion erases your books; unused credits are lost.

In the event of a serious breach of these terms, in particular repeated requests for prohibited content or circumvention of the service's limits, we may suspend or close your account after informing you, except in an emergency or where required by law.

12. Personal data

The processing of your data is described in our privacy policy.

13. Changes to the terms

These terms may change. Any substantial change will be announced in the app or by email before it takes effect.

14. Governing law and disputes

These terms are governed by French law. In the event of a dispute, first write to us at contact@code-family.fr: most situations are resolved this way.

If you are a consumer, you may use a consumer mediator free of charge [TO VERIFY: name and contact details of CODE FAMILY's consumer mediator]. Failing an amicable solution, the French courts have jurisdiction; if you are a consumer, you may also bring the matter before the court of your place of residence.
